I'm trying to limit the number of magical beasts overall, as the are relegated to few champion effects. So, if it can reasonably be a beast, I try to push it that way.
Black dragon is aquatic to be in line with its capacity to breath water, dwell in swamps, etc. Others have lacked this, but given that this is the elemental evil set, we wanted to squarely align it with water.
I personally didn't think sphinxes would allow a mount... but that might be just me.

I don't think I understand the question, exactly. If you mean the invisible miniatures, they are simply extra miniatures that can be used as proxies (legally).
